Terms of Service

1. Description of the Service

Leadify allows authenticated users to define geographic areas and search criteria to obtain listings of businesses or points of interest with contact data and metadata available from public sources or as configured in integrated flows (including execution via the data extraction vendor or other providers).

The Service uses a credit system: each search or detail level consumes credits according to rules published in the app. Subscription plans or credit packs may change in price or terms with reasonable notice where permitted by law.

2. Eligibility and account

• You must have legal capacity to contract and, unless we state otherwise, be at least 18 years old.
• Your account is personal or organizational per your identity provider (Clerk). You are responsible for credential confidentiality and all activity under your account.
• You may not create accounts fraudulently, impersonate others, or use the Service for unlawful purposes.

3. Credits, plans, and payments

3.1. Credits are consumed when you run searches or features that require them. Unless expressly stated in the Service, credits are not redeemable for cash and may expire or reset per your plan.

3.2. Subscription and top-up payments are processed through Mercado Pago. By paying, you also accept Mercado Pago’s terms. We do not store full card numbers on our systems.

3.3. Pricing and taxes: published prices may exclude applicable taxes, which will be charged per law and the payment processor’s configuration.

4. Subscriptions, billing, and no refunds

Recurring subscriptions renew per the purchased cycle until you cancel using options available in the Service or Mercado Pago, as applicable.

Except where mandatory law in your jurisdiction requires otherwise, payments are final: we do not offer refunds for unused credits, partial subscription periods, or change of mind. If local law grants a statutory withdrawal or refund right, that right applies only to the extent it is mandatory and cannot be validly waived.

We may suspend access for non-payment or material breach of these Terms.

5. Intellectual property in the Service

Software, design, the Leadify brand, documentation, and platform elements are ours or our licensors’. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service per these Terms.

You must not copy, decompile, reverse engineer, bulk-scrape the dashboard outside permitted exports, or bypass technical or credit limits.

6. Generated data, storage, and your responsibility

6.1. Your search results (including exports) are produced under your direction for your lawful internal use. To the extent permitted by law, you retain rights in datasets you compose or store in your account, without prejudice to third-party rights in underlying information (e.g., listed businesses, third-party database rights).

6.2. Leadify does not claim ownership of individual public contact records sourced externally; we may store and process copies in your account to provide the Service. You grant us a limited license to host, process, display, and back up such data while you use the Service.

6.3. You are solely responsible for your use of the data: data protection, direct marketing, database registration, IP, unfair competition, and sector rules. You should verify accuracy and currency before material decisions.

7. Acceptable use

• Do not use the Service for harassment, discrimination, unlawful bulk unsolicited outreach, or building databases for illicit ends.
• Respect underlying source and API terms (e.g., Google Maps/Places policies, data extraction vendor conditions) and applicable scraping/access laws.
• Do not submit third-party sensitive personal data without a proper legal basis.
• Do not abuse infrastructure or share credentials with unauthorized parties.

8. Third parties

The Service integrates third-party features. We are not responsible for those parties’ availability, accuracy, or practices. Your relationship with Clerk, Mercado Pago, the data extraction vendor, Mapbox, or others is direct as to their services.

9. Availability and changes

The Service is provided «as is» and «as available». We may modify, suspend, or discontinue features with or without notice when reasonable. We do not guarantee a specific uptime.

10. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect damages, lost profits, loss of data or reputation, or business decisions based on data obtained through the Service. Our aggregate liability for any claims related to the Service in any twelve (12) month period will not exceed the fees you paid us for the Service in that period (or zero if you only used a free plan).

Some jurisdictions do not allow certain exclusions; in that case, limits apply to the maximum extent permitted.

11. Indemnity

You will indemnify us against third-party claims arising from your unlawful use of the Service, processing data without proper legal bases, or breach of these Terms.

12. Termination

You may stop using the Service at any time. We may terminate or suspend access for breach, legal risk, or extended maintenance. After termination, we may delete your account data per the Privacy Policy and law.

13. Governing law and venue

Unless mandatory law provides otherwise, these Terms are governed by the laws of the country where the Service operator is domiciled as stated on the Website, and the courts of that country have jurisdiction, without prejudice to non-waivable consumer rights.
